#7 & past divorce

    I just left the bankruptcy attorney. Here is my situation. My divorce was final in February. Well I kept the house, and my car. I have been paying credit with credit since. I am behind, and just want a second chance. The divorce was hard enough, and I could have done with out all this!
    The lawyer told me, since the debt was accuired while we were married it is community debt. Even though it is my name on the account only. He said it was was unique to Texas. That if I file the creditors go after the X. And she can stop or dismiss the bankruptcy. And that the only solution is to have her file too. I no longer communicate with the X. We are not even as much as able to say hi in the store if we pass each other. So if this is all true, She wont file, and she will be Johhny on the Spot to stop me from doing it. Have any of you heard of this, and what is the result? And if this is for real, what do I do? I tried C.C.C. and they really could not help me. She even suggested #7. Any help you provide is greatly appriciated! Thanks to you all!

    What you were told is not true!!!
    I was in the same position, after my divorce in Houston, Tx.
    and I had to file chapter 7. And, my ex could do nothing about it. But, once you file and the debt discharge, the creditors will go after her.

    The only good thing about it is you will no longer have to worry about the debts. It made me feel good not to have to worry about the debts anymore.

    Anyway, I hope this helps. Also, you do not need an attorney to file. In Houston there is a internet company that has everything automated. They are called Easybkdocs.com, I used them and everything went very smoothly and it only cost me $199. All of the documents were perfect!!
