    I filed for bankruptcy 3 years ago. At the time, my family had a share of property in a probate hearing. When probate closed, each of 10 family members had a 1/8 share in 80 acres of property.Several of the family members are indigent and are not able to pay the taxes on the property. The agricultural part of the property is being leased and it pays the yearly taxes on all 80 acres. The trustee that is handling my bankruptcy wants to take all 80 acres because he cannot get the leased agricultural property. He is holding up my discharge for the sake of 8 acres of property. Can he legally auction the property from under us and sell us back 72 acres or is he just blowing smoke? Can he also hold up my bankruptcy discharge until the statute of limitations runs out on my creditorss?

    I don't know for sure.  You really need to ask your attorney if you have one.  

    Trustees can pretty much do anything they want to...  so I doubt he's blowing smoke unless you live in a real 'creepy' small town in nowhere America, and he thinks he can pull a fast one.  If so...get a Big-City attorney somewhere in your state.

    You've already filed bankruptcy...what statue of limitations even exist?  It's a done deal baby!  You filed already!!!  :)
