How often can you file bankruptcy in Minnesota?

If you have already filed for bankruptcy and find yourself deep in debt again, you may be wondering whether there's a limit on how many times you can resort to bankruptcy to discharge your debts. There's no lifetime limit on how many times you can file for bankruptcy, in Minnesota or any other state. However, you do have to wait a certain period of time after your earlier bankruptcy case before you can file again.
Filing Under Chapter 7
You must wait eight years after filing an earlier Chapter 7 case in which you received a discharge to file another Chapter 7 case. If you filed your earlier case under Chapter 13, you have to wait six years. (This time limit doesn't apply if you received a discharge in the earlier Chapter 13 case and you paid off at least 70% of your unsecured debt through your repayment plan.)
Filing Under Chapter 13
You must wait four years after filing an earlier Chapter 7 case to receive a discharge under Chapter 13. If your previous case was filed under Chapter 13, you only need to wait two years to get a subsequent Chapter 13 discharge.
